{"id":3891,"date":"2025-06-20T14:16:50","date_gmt":"2025-06-20T14:16:50","guid":{"rendered":"https:\/\/digkrypton.com\/index.php\/2025\/06\/20\/the-clarity-act-shouldnt-be-included-in-the-genius-act-say-senator-hagerty-analysts\/"},"modified":"2025-06-20T14:16:50","modified_gmt":"2025-06-20T14:16:50","slug":"the-clarity-act-shouldnt-be-included-in-the-genius-act-say-senator-hagerty-analysts","status":"publish","type":"post","link":"https:\/\/digkrypton.com\/index.php\/2025\/06\/20\/the-clarity-act-shouldnt-be-included-in-the-genius-act-say-senator-hagerty-analysts\/","title":{"rendered":"The CLARITY Act Shouldn\u2019t Be Included in the GENIUS Act Say Senator Hagerty, Analysts"},"content":{"rendered":"<p><a href=\"https:\/\/bitcoinmagazine.com\/\">Bitcoin Magazine<\/a><\/p>\n<p><a href=\"https:\/\/bitcoinmagazine.com\/politics\/the-clarity-act-shouldnt-be-included-in-the-genius-act-say-senator-hagerty-analysts\">The CLARITY Act Shouldn\u2019t Be Included in the GENIUS Act Say Senator Hagerty, Analysts<\/a><\/p>\n<div><\/div>\n<p>On Tuesday, <a href=\"https:\/\/bitcoinmagazine.com\/news\/u-s-senate-passes-stablecoin-bill-the-genius-act\">the U.S. Senate passed the GENIUS Act (S. 394)<\/a>, which would establish a comprehensive federal framework for U.S. dollar-denominated stablecoins.<\/p>\n<p>Now, I know some of you are rolling your eyes because Bitcoin Magazine is covering a stablecoin bill.<\/p>\n<p>To you, I have two things to say:<\/p>\n<p>Firstly, you should still pay attention to crypto bills like the GENIUS Act, because <a href=\"https:\/\/bitcoinmagazine.com\/takes\/bitcoiners-should-care-about-the-genius-act\">they could impact your ability to use bitcoin privately<\/a>.<\/p>\n<p>Secondly, the GENIUS Act might get combined with the CLARITY Act (also referred to as the \u201cmarket structure\u201d bill), which would <a href=\"https:\/\/bitcoinmagazine.com\/news\/the-clarity-act-heads-to-house-floor-for-vote-with-protection-for-noncustodial-tools-intact\">protect developers and providers of noncustodial Bitcoin tools and services<\/a>.<\/p>\n<p>With that out of the way\u2026 One day after the bill passed the Senate, President Trump posted a message on Truth Social urging the members of the U.S. House of Representatives to pass the act without amending it.<\/p>\n<div class=\"wp-block-embed__wrapper\">\n<p>Thank you President <a href=\"https:\/\/twitter.com\/realDonaldTrump?ref_src=twsrc%5Etfw\" target=\"_blank\">@realDonaldTrump<\/a> for delivering on your promise to make the USA the crypto capital of the planet! <a href=\"https:\/\/t.co\/WAZViAeJ6m\" target=\"_blank\">pic.twitter.com\/WAZViAeJ6m<\/a><\/p>\n<p>\u2014 David Sacks (@davidsacks47) <a href=\"https:\/\/twitter.com\/davidsacks47\/status\/1935500283825545633?ref_src=twsrc%5Etfw\" target=\"_blank\">June 19, 2025<\/a>\n<\/p><\/div>\n<p>However, some House leaders quickly began <a href=\"https:\/\/www.cryptoinamerica.com\/p\/genius-act-clears-senate-but-house\" target=\"_blank\">pushing to package the GENIUS Act with a version of the CLARITY Act<\/a>.<\/p>\n<p>Senator Hagerty <a href=\"https:\/\/www.youtube.com\/watch?v=CSdhHkH8nMk\" target=\"_blank\">stated on the Bankless podcast on Wednesday<\/a> that he thought combining the GENIUS Act with the CLARITY Act would hurt the chances of the GENIUS Act passing.<\/p>\n<p>\u201cIf the House of Representatives sends back something that\u2019s different [than the version of the bill that passed the Senate], then that\u2019s going to give those who are already opponents of the bill the opportunity to say \u2018Well, we tried \u2014 we gave you our vote, but you changed it on us,\u2019 and we\u2019re going to be right back to square one,\u201d he added.<\/p>\n<p>(In the U.S. legislative process, if an amendment to a bill is made in the House of Representatives after it passes the Senate, it must be sent back to the Senate to be voted on again, where it needs 60 out of 100 votes to pass.)<\/p>\n<p>The senator added that the CLARITY Act still needs to be shaped up before it\u2019s voted on in the Senate.<\/p>\n<p>\u201cWe have great momentum with this bill, but it\u2019s going to take some time,\u201d said Senator Hagerty.<\/p>\n<p>\u201cThere\u2019s a divide in terms of understanding the technology, where there may be more people who understand it [and who] are comfortable with it in the House of Representatives,\u201d he added.<\/p>\n<p>\u201cWe\u2019ve got more work to do here in the Senate for some of the aspects of the market structure bill that are going to require more education.\u201d<\/p>\n<p>Head of Firmwide Research at <a href=\"https:\/\/www.galaxy.com\/\" target=\"_blank\">Galaxy Digital<\/a> Alex Thorn is of the same mind as Senator Hagerty in that he feels merging the GENIUS Act with the CLARITY Act is a bad idea.<\/p>\n<p>\u201cGENIUS represents months of bipartisan negotiation that led to landslide bipartisan passage in the Senate \u2014 68-30, with 18 Democrats voting in favor,\u201d said Thorn.<\/p>\n<p>\u201cThere\u2019s no guarantee the Senate outcome would look similar in a combined version. In fact, it\u2019s unlikely,\u201d he added.<\/p>\n<p>Thorn also echoed Senator Hagerty\u2019s sentiment as he added that \u201cmarket structure is extremely complex\u201d and that it will take some time to iron out some of the details in the bill.<\/p>\n<p>He also noted that \u201cDemocrats have been demanding that a provision addressing the Trump family\u2019s crypto ventures be added to market structure.\u201d<\/p>\n<p>\u201cIf such a provision is not added, market structure will have a very tough time getting to 60 votes in the Senate,\u201d said Thorn. \u201cThe House should pass a clean GENIUS Act now and then turn to the task of crypto market structure.\u201d<\/p>\n<p>Head of Policy at the <a href=\"https:\/\/www.btcpolicy.org\/\" target=\"_blank\">Bitcoin Policy Institute<\/a> Zack Shapiro also sees the value in getting the GENIUS Act across the finish line without adding the CLARITY Act to it.<\/p>\n<p>\u201cThe GENIUS Act is seen as bipartisan and not controversial,\u201d Shapiro told Bitcoin Magazine. \u201cThe CLARITY Act might be more controversial or more of a political lift, and [it could] really put both of [the bills] at risk if they\u2019re tied together.\u201d<\/p>\n<p>With that said, Shapiro understands why Bitcoin enthusiasts who don\u2019t care much about stablecoin legislation might want to see the CLARITY Act worked into the GENIUS Act.<\/p>\n<p>\u201cIf you are taking a Bitcoin-only lens, and that\u2019s literally the only thing you care about, then maybe the answer is you do tie these together because you don\u2019t really care about the GENIUS Act,\u201d explained Shapiro.<\/p>\n<p>\u201cIn many ways it would be great to get them both done and not leave the CLARITY Act hanging \u2014 especially with the <a href=\"https:\/\/bitcoinmagazine.com\/takes\/support-the-blockchain-regulatory-certainty-act-brca-to-protect-noncustodial-services\">BRCA<\/a> protections that are in <a href=\"https:\/\/x.com\/Eth_Dev_News\/status\/1931872535697850387\" target=\"_blank\">Section 110<\/a>.\u201d<\/p>\n<p>The language in Section 110 in the CLARITY Act was taken from the Blockchain Regulatory Certainty Act (BRCA), and it protects developers and service providers of noncustodial Bitcoin and crypto technology.<\/p>\n<p>Speaking more objectively, though, Shapiro remained in favor of keeping the two bills separate.<\/p>\n<p>\u201cI expect the CLARITY Act to be a much bigger political lift than just passing [it in a] version of the GENIUS Act,\u201d he said. \u201cAnd if we don\u2019t get any crypto bills passed, then there\u2019s just not going to be an appetite to do this in the future.\u201d<\/p>\n<p>This post <a href=\"https:\/\/bitcoinmagazine.com\/politics\/the-clarity-act-shouldnt-be-included-in-the-genius-act-say-senator-hagerty-analysts\">The CLARITY Act Shouldn\u2019t Be Included in the GENIUS Act Say Senator Hagerty, Analysts<\/a> first appeared on <a href=\"https:\/\/bitcoinmagazine.com\/\">Bitcoin Magazine<\/a> and is written by <a href=\"https:\/\/bitcoinmagazine.com\/authors\/frank-corva\">Frank Corva<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Bitcoin Magazine The CLARITY Act Shouldn\u2019t Be Included in the GENIUS Act Say Senator Hagerty, Analysts On Tuesday, the U.S. Senate passed the GENIUS Act (S. 394), which would establish a comprehensive federal framework for U.S. dollar-denominated stablecoins.
