Tom Emmer (R-MN) and Rep. Ritchie Torres (D-NY)<\/a>, provides \u201csafe harbor from licensing and registration for certain non-controlling blockchain developers and providers of blockchain services.\u201d<\/p>\n<div class=\"wp-block-embed__wrapper\">\n<p>Critical Bitcoin legislation was introduced last week &amp; it needs our support <\/p>\n<p>The Blockchain Regulatory Certainty Act (BRCA) by <a href=\"https:\/\/twitter.com\/GOPMajorityWhip?ref_src=twsrc%5Etfw\" target=\"_blank\">@GOPMajorityWhip<\/a> and <a href=\"https:\/\/twitter.com\/RitchieTorres?ref_src=twsrc%5Etfw\" target=\"_blank\">@RitchieTorres<\/a> protects self-custody developers, miners, and nodes from being classified as money transmitters.  <\/p>\n<p>Thread  <a href=\"https:\/\/t.co\/cJ8Ogno3h5\" target=\"_blank\">pic.twitter.com\/cJ8Ogno3h5<\/a><\/p>\n<p>\u2014 Nick Neuman (@Nneuman) <a href=\"https:\/\/twitter.com\/Nneuman\/status\/1928509045113004138?ref_src=twsrc%5Etfw\" target=\"_blank\">May 30, 2025<\/a>\n<\/p><\/div>\n<p>It also stipulates that no blockchain developer or provider of a blockchain service shall be treated as a money transmitter unless the developers or providers behind the project have control over user funds.<\/p>\n<p>This bill is relevant because the developers for both <a href=\"https:\/\/bitcoinmagazine.com\/legal\/bitcoin-privacy-on-trial-samourai-developers-first-court-hearing-recap\">Samourai Wallet<\/a> and <a href=\"https:\/\/bitcoinmagazine.com\/legal\/tornado-cash-loses-motion-to-dismiss\">Tornado Cash<\/a> are currently facing charges for operating unlicensed money transmitter businesses, despite the fact that the developers for neither of these technologies ever had control over user funds.<\/p>\n<div class=\"wp-block-embed__wrapper\">\n<div class=\"youtube-embed\"><\/div>\n<\/div>\n<p>It\u2019s also important because, under the Biden administration, the U.S. Department of Justice (DoJ) didn\u2019t just classify privacy services as money transmitters, but ancillary services such as Lightning nodes, rollup sequencers, and other Bitcoin and blockchain technology, as well.<\/p>\n<p>If the BRCA isn\u2019t enacted into law, there is a risk that all Bitcoin and crypto wallets as well as other noncustodial services and technologies will be made illegal and\/or subject to <a href=\"https:\/\/bitcoinmagazine.com\/culture\/kyc-bitcoin-and-the-failed-hopes-of-aml-policies-preserving-individual-freedom\">KYC\/AML<\/a> laws.<\/p>\n<p>While Rep. Emmer and Rep.
